Kerry's Confident Communication Club Terms and Conditions

This agreement must be read, understood and agreed to. Upon signing this Agreement, you are accepting the Terms and Conditions herein.

Responsibilities of Membership

  • You agree to use your best endeavours to attend and participate in each meeting during your membership.
  • You agree to pay the membership fee and understand that your seat is only reserved if payment is received within the account terms provided on your invoice.
  • You understand that the membership fee is not refundable, in whole or in part regardless of whether you attend meetings or not.
  • You agree to provide 14 days written notice if you intend to discontinue your membership and if notice is not given within this timeframe; your membership payment is due in full.
  • Upon cancellation, your seat will be available to someone else, and you will be removed from our private Facebook group and no longer receive event discounts.
  • You agree that as a Tier 3 member, it is your responsibility to book ahead for your 1:1 coaching sessions and that each should be used by the end of each quarter.
  • You agree that Kerry Pienaar may, in her absolute discretion, cancel your membership and terminate this agreement by giving you 14 days’ notice in writing. If the membership is terminated in accordance with this clause, any refund will be calculated in accordance with the date fees have been paid.
  • As this is a confidential space and it takes time to develop trust to share information with the group, stand-ins cannot be sent to replace you if you cannot attend a meeting.
  • You are committing to a monthly or annual membership regardless of your payment terms.
  • You acknowledge that, under normal circumstances, refunds or credits for missed meetings will not be provided.
  • This policy is in place to ensure the fair and consistent treatment of all members.
  • In exceptional situations, Kerry Pienaar may consider requests for refunds or credits and you understand that this will be reviewed on a case by case basis, and any decision to grant a refund or credit will be at her sole discretion.

Confidentiality & Liability

  • All discussions, conversations and presentations are confidential. You agree that the information divulged by other members of Kerry's Confident Communication Club to you is confidential and may not be disclosed by you to third parties.
  • The obligations of confidentiality in this agreement are ongoing and survive its termination.
  • The releases in this section are ongoing and survive the termination of this agreement.
  • The information provided by Kerry Pienaar and as part of Kerry's Confident Communication Club is general only and should not be taken to be financial, business, or legal advice. It has been given without considering your objectives, financial situation, or needs.
  • Before acting on this information, you should consider the appropriateness of the information, having regard to your own objectives, business and financial situation, and needs.
  • Kerry Pienaar as part of Kerry's Confident Communication Club disclaims all and any guarantees, undertakings, and warranties, expressed or implied, and is not liable for any loss or damage whatsoever (including human or computer error, negligent or otherwise, or incidental or consequential loss or damage) arising out of, or in connection with, any use or reliance on the information or advice in this membership.
  • You must accept sole responsibility associated with the use of the material in this program, irrespective of the purpose for which such use or results are applied. The information in this program is no substitute for specialist advice.
  • Kerry's Confident Communication Club, its facilitators, speakers, and members, offer their comments, suggestions and feedback only to stimulate analysis and discussion and not in such a way that they specifically will be acted upon or relied upon by you.
  • You are solely responsible for your own actions and decisions, and any results based upon the suggestions and comments given and will evaluate the value and correctness of such comments or suggestions.
  • If any provision of this Agreement is held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision of this Agreement, and this Agreement shall be construed as if the invalid, illegal, or unenforceable provision had never been contained herein.
  • The parties shall make a good faith effort to replace any such provision with a valid, legal, and enforceable provision that achieves, to the greatest extent possible, the original intentions of the parties.
  • Kerry Pienaar reserves the right to modify or amend these Terms and Conditions at any time, and such changes will become effective upon notice to members.
  • Kerry Pienaar will make reasonable efforts to provide advance notice of any modifications. Notice may be given through email notification and it is the responsibility of the member to ensure that their contact information is accurate and up to date and that they keep up to date with such correspondence.
  • The provisions of this Agreement shall survive the termination of this Agreement and/or the termination of your Kerry's Confident Communication Club membership to the extent necessary to effectuate the terms contained herein.
